The UAE Government has issued a federal decree-law on traffic regulation

The UAE Government has issued a new federal decree-law on traffic regulation, reflecting the UAE’s ongoing legislative advancements.

This decree-law is designed to keep pace with the global evolution in transportation, updating vehicle classifications and implementing modern road technologies. It emphasizes the expansion of self-driving vehicles, electric cars, and various personal mobility devices, alongside advanced technology solutions that leverage the UAE’s sophisticated road infrastructure.

According to the decree-law, a Cabinet resolution will specify the inspection, licensing, and renewal requirements for self-driving vehicles, as well as protocols for testing new vehicle technologies.

The decree-law enables the adoption of innovative technologies for road safety, including the issuance of fines for violators. Licensing authorities are directed to establish online and smart programs for obtaining licenses and permits, as authorised by the Minister of Interior or heads of licensing authorities in each emirate.

The decree-law also establishes a “Federal Traffic Council,” with its composition, duties, and procedures to be outlined by a Cabinet resolution on the Minister of Interior’s proposal.

Road Use Regulations

The decree-law provides comprehensive regulations for all vehicle types, drivers, and pedestrians. Pedestrians are prohibited from crossing roads with speed limits over 80 km/h, bearing civil or criminal liability for violations. Additionally, it is prohibited to stop or place vehicles on roads or curbs for repairs or to stand in the roadway.

Requirements for Obtaining a Driving License

To obtain a driving license, applicants must be at least 17 years old. Driving trainers must hold appropriate licenses for the vehicle type they train on and be authorized by the licensing authority. Trainers may only allow trainees to drive within populated areas if they are confident in the trainee’s ability to maintain vehicle control. Licensing authorities may suspend, cancel, or refuse renewal of a license if the holder is deemed unqualified or medically unfit to drive.

The decree-law prohibits major modifications to a vehicle’s structure, body, engine, or color without the licensing authority’s approval. Insurance policies must fully cover civil liabilities for injuries, death, or property damage caused by a vehicle.

Deterrent Penalties

A Cabinet resolution will outline penalties, administrative actions, and grievance procedures. Violations carry deterrent penalties, such as imprisonment and fines starting from AED 20,000 for misuse of license plates, and escalating up to AED 200,000 or imprisonment for driving under the influence of alcohol or narcotics.

Driving with a suspended license may result in imprisonment of up to three months or a fine of at least AED 10,000. Fleeing an accident scene can lead to imprisonment of up to one year and a fine between AED 50,000 and AED 100,000. Causing a death due to negligence carries penalties of imprisonment and fines of at least AED 50,000, which increase under specific aggravating circumstances, such as driving during floods.

Pedestrians crossing roads outside designated areas, if leading to a traffic accident, may face imprisonment and fines ranging from AED 5,000 to AED 10,000.
